Erika Girardi Lawsuit Settlement Ends $25 Million Bankruptcy Case

Erika Jayne’s erika girardi lawsuit settlement halted a $25 million bankruptcy fight days before trial was set to start. During a Thursday, May 21 pretrial conference, the plaintiff and Jayne told the judge they had reached an agreement.

May 26 Filing Deadline

The two sides now have until Tuesday, May 26, to file a settlement notice and dismissal request. That is the cleanest way for a case like this to end without the uncertainty of a courtroom fight over whether Jayne must repay money tied to Girardi Keese.

The lawsuit, filed in 2021, came from the trustee overseeing the bankruptcy case involving Tom Girardi’s former law firm. The trustee alleged that Jayne knew the firm had covered her expenses for at least 12 years and sought repayment of the $25 million plus interest.

Jayne’s attorney denied the accusations and said she does not have legal liability in the matter. The case was built around the trustee’s effort to recover money for creditors and former clients of the defunct firm, so the settlement removes a trial that could have tested those claims in public.

The trustee’s side had argued that “The law firm paid out over $25 million in expenses which were approved and generated by one person, Erika Girardi.” The same lawyer said, “We are hopeful that Ms. Girardi comes down the mountain from a place of privilege and obscene wealth and returns some of these expenses so the former clients and creditors of this law firm can mitigate the horrific and unfair losses perpetrated by her husband and others.”

Erika Girardi After Divorce Filing

Jayne filed for divorce from Tom Girardi in 2020 after two decades of marriage, and the divorce proceedings were paused after both were named in a fraud lawsuit. She has maintained her innocence and said she had no knowledge of her then-husband’s alleged misconduct.

Tom Girardi was sentenced to seven years in prison in June 2025, and the settlement now lets Jayne leave one of the most visible civil disputes tied to that collapse without a trial record that could have deepened the damage.
