U.S. District Judge Rita Lin blocked the Pentagon in the Anthropic lawsuit against the Department of Defense, ruling on Thursday night that the government acted illegally against Anthropic. The written order came after Anthropic challenged a supply chain risk designation in March. Lin said the case turned on retaliation, not a lawful security finding.
In her 59-page ruling, Lin wrote that the government's actions were based on a desire to make a public example out of Anthropic for its “arrogance” in criticizing the government, not based on any articulable basis to believe that Anthropic would actually sabotage its model. She also wrote that neither the Constitution nor the federal statute the government invoked allows sweeping penalties based principally on Anthropic’s critique of the Administration’s views.

The dispute began in February when Donald Trump and Pete Hegseth accused Anthropic of endangering national security and designated the company a supply chain risk. Anthropic then sued the Pentagon in March over that designation. The company said the action was an unlawful campaign of retaliation over its refusal to allow unrestricted military use of its technology.
Anthropic CEO Dario Amodei had refused to back down over concerns that the company's products could be used for mass surveillance or autonomous armed drones. That refusal put the company in direct conflict with the Department of Defense over how AI should be used, and the legal fight widened into a public dispute over AI in warfare and mass surveillance.

Lin's ruling changes the legal status of the Pentagon's action against Anthropic. The designation had been the government's basis for punishing the company, and the judge's order removes that foundation unless it survives the next round of litigation. The government is expected to fight the ruling.
Anthropic said it welcomed the judge's ruling. A spokesperson said, “We remain focused on working productively with the government to harness AI for our national security so all Americans benefit from this technology.” The White House did not immediately respond to a request for comment.
