David Raybin on Tennessee law

David Raybin said an execution must be carried out through Tennessee’s legally prescribed execution process at the prison. He said doctors could not end Pike’s life at a hospital simply because she remains under a death sentence.

“The death sentence was imposed by a court, but it was to be done at the prison. They can not 'execute' her at a hospital by removing her life support. That would be murder,” Raybin said in WZTV. He added, “It could be thousands of thousands of dollars but that’s attributable to the failure of the state to carry out the execution in an inappropriate manner,” and, “Given the unusual circumstances here, I think the Department of Correction would require her family, if that’s what they were wanting to do, to have a judicial determination,”

Bill Lee and life support

Christa Pike’s attorneys have asked Governor Bill Lee to commute her death sentence. That request sits alongside the immediate medical question: Pike remained on a ventilator after the failed execution, and her long-term prognosis remains unclear.

Raybin’s comments sketch the next step if Pike’s family wants to change her medical care. A judge would likely need to approve that move, which would put the Department of Correction, the family, and the court on the same track even after the execution attempt has already collapsed.

After Wednesday

Stephen Ferrell told that Pike has remained unconscious since the execution attempt. That leaves one fact at the center of the case: the state tried to carry out the sentence, but Pike survived the process and was moved to treatment instead.

The open issue now is not whether the sentence existed, but who has authority over Pike’s care while she remains unconscious after Wednesday night. Any decision to alter that care would run through the legal process Raybin described, not through the prison execution chamber.
