Nahla Aubry filed a declaration in Los Angeles Superior Court backing Halle Berry and rejecting Olivier Martinez’s abuse allegations. The filing puts the 18-year-old directly into a custody fight tied to claims about Maceo Martinez, making her account the most personal rebuttal yet.
Sept. 29 Call With Maceo
Nahla Aubry said she last spoke with Maceo Martinez on Sept. 29 while Halle Berry was driving him to school. She said he sounded happy during the speakerphone call and did not seem upset about anything, a small but pointed detail in a dispute built around what happened at home and what the child was told afterward.
She also said she has not reached out to him because she is uncertain what is permitted under Olivier Martinez’s court filings. That leaves the family communication line constrained by the same legal fight now shaping the evidence in Los Angeles Superior Court.
Berry as parent
Nahla Aubry described Halle Berry as a loving and devoted parent who can be strict when necessary. She said her mother attended Maceo Martinez in games, drove him to practices and tournaments, and advocated for his education, which adds a day-to-day picture that conflicts with the abuse claims.
She said, “I have never seen my mom hit, slap, choke, grab, or physically abuse Maceo in any way.” She added, “I have never seen my mom place her hands around Maceo’s neck, put him in a chokehold, restrict his breathing, or engage in any conduct remotely resembling the allegations that have been made against her.”
Sept. 26 allegations
Olivier Martinez accused Halle Berry of choking Maceo Martinez during an alleged Sept. 26 altercation at her home. He claimed she grabbed him by the neck and choked him during an argument that began while he was playing a virtual reality game, and that is the version Nahla Aubry squarely rejected.
She said, “I never observed anything abusive about her parenting.” She also said she was shocked, very sad and very upset when she learned of the allegations, and added, “I want very much to speak with my brother and check on him. I want him to know that I love him,” before saying, “My mom is biracial, I am biracial and Maceo is biracial.”
Los Angeles Superior Court
Nahla Aubry said she lived with Maceo Martinez for most of his life while splitting time between Halle Berry’s home and Gabriel Aubry’s residence before moving from California to Massachusetts to attend college. Her declaration matters because it comes from someone close enough to describe the family’s routine, yet removed enough to speak as an independent witness rather than a party.
For the court, the declaration gives a direct family witness against allegations made in a restraining order request. For everyone watching the custody fight, the next move belongs to Los Angeles Superior Court, which now has both the accusation and a first-person denial from Halle Berry’s daughter in the record.
