The Mayor of New York City has issued Executive Order 06, establishing a Mayor’s Advisory Committee on the Judiciary. This initiative aims to enhance the process of judicial appointments in the city by ensuring transparency, ethics, and integrity.

Key Elements of Executive Order 06

The executive order outlines several crucial aspects of the newly formed Committee:

  • Purpose: The Committee is designed to recruit, evaluate, and recommend qualified candidates for judicial appointments.
  • Judicial Scope: It will assess candidates for the Criminal Court, Family Court, and provisional appointments in the Civil Court.

Committee Functions

The Committee carries out a range of functions, which include:

  • Recruiting highly qualified candidates.
  • Evaluating candidates based on their character and legal experience.
  • Referring potential nominees to the Department of Investigation for screening.
  • Nominating three candidates for each judicial vacancy.
  • Assessing incumbent judges for reappointment.

Public Engagement

Public participation is vital to this process. The Committee will:

  • Conduct public hearings for nominees, allowing community input.
  • Reconsider nominations based on public feedback.

Committee Structure

The Committee will consist of nineteen members, including:

  • Nine appointed by the Mayor, including a Chairperson.
  • Four nominated by the Chief Judge of the New York Court of Appeals.
  • Two each from the Presiding Justices of the Appellate Division.
  • One each from two law school deans appointed biannually.

Confidentiality and Ethics

Confidentiality will be strictly maintained regarding candidates’ qualifications. The Committee will adhere to ethical obligations as outlined in the New York City Charter.

Financial Provisions

Although Committee members will serve without compensation, they will receive assistance from paid staff to carry out their duties effectively.

Revocation of Previous Orders

Executive Order 06 revokes Executive Order No. 14, dated April 12, 2022, abolishing the previous Committee on the Judiciary.

Effective Date

This new order takes effect immediately, marking a significant shift in how judicial appointments will be handled in New York City.
