Defense Seeks to Disqualify Prosecutors in Alleged Charlie Kirk Assassination Case
Tyler Robinson, a 22-year-old accused in the killing of prominent conservative activist Charlie Kirk, is set for a significant court appearance in Utah. His defense team is seeking to disqualify the Utah County Attorney’s Office, claiming a conflict of interest arises from a family member associated with one of the prosecutors.
Case Background and Allegations
The hearing will address claims made by Robinson’s lawyers during a prior session on October 24. At that time, it was noted that an attorney’s 18-year-old child was present at the incident on September 10, during Kirk’s speech at Utah Valley University. This information has been withheld from public documents.
Defense attorney Richard Novak highlighted the potential conflict, stating that a family member of a prosecutor was near the shooting scene. “Law enforcement was deployed to the area with her safety and status in mind,” Novak remarked, emphasizing the gravity of the situation.
Prosecution’s Response
The county attorney’s office contends that no actual conflict of interest exists. They argue that the attorney’s daughter did not witness the shooting or any related dangerous behavior. Consequently, they have no plans to call her as a witness, citing her knowledge as hearsay.
In response to the defense’s motions, the attorney’s office indicated that their decision to pursue the death penalty swiftly is justified. They state that “there is nothing unusual about filing a death penalty notice prior to a preliminary hearing.” Prosecutors are bound by law to declare their intent to seek the death penalty within 60 days post-arraignment.

The alleged brutal shooting occurred during Kirk’s appearance at the university last year and was widely witnessed by students and online viewers. Following the incident, law enforcement executed an extensive 30-hour manhunt for a sniper who purportedly fired from a neighboring roof.
Charges Against Robinson
Robinson faces multiple serious charges, including:

His charges include enhancements for targeting victims, as well as the aggravating factor of committing a violent offense in the presence of a child. Evidence against him comprises DNA found on the suspected murder weapon and a confession.
