The woman reported the alleged sexual assault to law enforcement at a southern Utah hospital on February 27, 2025. According to the charges, Kingston visited her home early in the morning, where they watched a movie and engaged in some sexual activity that did not involve intercourse initially.

However, the situation escalated when Kingston allegedly forced her to have sex despite her repeated requests to stop. The documents state that after a brief break, Kingston resumed sexual advances, which the woman resisted.

In court documents, it was revealed that before meeting Kingston, the woman had expressed to forensic experts her lack of consent for sexual intercourse. Despite her objections, Kingston later claimed that “all sexual activity was consensual.”
