Caleb Yirenkyi: Federal court rejects Partey visa appeal, Ghana opener hit

Thomas Partey will miss Ghana's World Cup opener against Panama after a federal court in Ottawa rejected the Ghanaian government's visa appeal. The decision means the Ghana midfielder, named as caleb yirenkyi in this file, will not be available for Wednesday's match in Toronto.

Ottawa ruling

The court said there was "no serious issue in the underlying refusal" of the visa. It also said "the applicant failed to disclose that he is the subject of multiple criminal charges for sexual violence in the UK". Ghana had asked for permission for him to enter Canada briefly so he could play.

Immigration, Refugees and Citizenship Canada said Canada has been consistent that hosting major events does not change Canada's immigration laws. The department also said every person seeking to come to Canada is assessed individually, based on the facts available and the law that applies.

Partey and the charges

Partey pleaded not guilty to seven charges of rape and one count of sexual assault. The allegations relate to four different women between 2020 and 2022, and he is scheduled to stand trial next year. The court noted that having reasonable grounds to believe that an offence has been committed is enough under immigration rules, and that a conviction is not required to find an applicant inadmissible.

IRCC officials had written to Partey to express concerns about whether his application had met the requirement to answer truthfully, referencing legislation covering misrepresentation that could affect a visa. U.S. customs and border protection said he had not been convicted of a crime and was admitted to the United States after being issued a visa.

Ghana's schedule

Carlos Queiroz said he had no qualms over selecting Partey before the tournament. He said, "My business is to play with the cards that I have in front of me." Asked about the issue again on Tuesday, he said, "We are waiting for a decision. When the decision [arrives], we are ready."

Ghana's immediate schedule now moves to England in Boston on 23 June and Croatia in Philadelphia on 27 June. Partey has played more than 50 times for Ghana and made his debut in June 2016, but this ruling leaves the team without one of its established midfield options for the opener in Toronto.
