The Crown Prosecution Service asked a US court on Monday to keep Tristan Tate and Andrew Tate in jail while extradition proceedings continue in Florida. Tristan Tate has been held there since his arrest in Miami on 19 July, and a Thursday detention hearing will decide whether the brothers remain detained.
The filing puts 59 charges at the center of the dispute. The charges include rape, sex trafficking, and indecent images of a child, and prosecutors also pointed to allegations from four new accusers covering 2010-17, alongside earlier UK charges brought in 2025 involving three other accusers.
Both sides filed new documents in the Southern District of Florida federal court. The British Embassy in Washington sent a request to the US Department of State to deny bail, keeping the issue in the same track as the extradition proceedings tied to the UK case.
Prosecutors cite flight risk
The Crown Prosecution Service says the brothers are a flight risk and said they would try to interfere with witnesses. Prosecutors argued in court filings that “Both Andrew and Tristan Tate have significant resources available to them, both in terms of money and in social media networks.”
Prosecutors also wrote that “All of the complainants in this case are vulnerable and in fear of Andrew and Tristan Tate because of the violence used towards them – several of the complainants describe being assaulted and threatened with weapons – and because of the resources available to Andrew and Tristan Tate, and because of their propensity to intimidate vulnerable complainants.”
That is the point the judge will weigh on Thursday: whether those arguments justify keeping Tristan Tate and Andrew Tate jailed while extradition proceedings move forward, or whether bail changes their custody status before Britain seeks their return.
UK charges and Romania path
The new charges relate to allegations spanning 2010-17. The earlier 2025 UK case covers rape, bodily harm, human trafficking, and controlling prostitution for gain relating to three other accusers in the UK between 2012 and 2015.
Police in Bedfordshire secured European arrest warrants in 2024 to have the brothers returned from Romania. The brothers moved to Romania in 2016, were arrested on sex charges in Romania in 2022, and later traveled to the US after travel restrictions in Romania were lifted in early 2025.
For Tristan Tate, the immediate issue is custody in Florida. The Thursday detention hearing will decide whether he and Andrew Tate stay in jail while the extradition proceedings continue.
