Joshua Foster was fined €3,000 after his two-year-old son died in a fall from a fourth-floor window at the King Evelthon Beach Hotel And Resort in Cyprus. The boy fell nearly 40ft at the hotel on 12 July and later died at Paphos General Hospital.
Foster, 37, admitted causing death through a reckless, rash or dangerous act. He told reporters: “Thank you for the support. I'm looking forward to going home and being with my wife and daughter.”
Paphos District Court sentence
The Paphos District Court imposed the fine on Friday morning. The amount was £2,500, and the case ended with a financial penalty rather than custody.
Police were called at about 18:40 after reports that a child had fallen under unknown circumstances. Earlier, Foster said in a voluntary statement to police that the boy fell before he had a chance to grab him.
Joshua Foster and Alexandros Alexandrou
Alexandros Alexandrou said Foster was in a good mood before the incident and was playing with his son. He also described what happened before Foster could react as “inconceivable” and said Foster’s life had “changed forever”.
The court heard the window was 2.85m wide and 1.2m high. The family had arrived in Cyprus hours before the incident, and the fall happened on the first day of the holiday in Chlorakas after a day that included a visit to the pool.
Foster had been held in custody for eight days after the incident. He left court with the fine imposed and a return home now in view.
