The ASG highlighted a complaint by a member of the five-person examining committee, which viewed the film on December 19. This complaint alleged that his objections were not considered before the committee recommended a U/A 16+ certificate with certain excisions.

The ASG emphasized that the CBFC chairman’s referral of the film to a revising committee was within legal powers. This committee would include a larger number of members, allowing for a comprehensive evaluation of the film. The chairman’s decision to refer the film aims to ensure that all concerns are adequately addressed before issuing a censor certificate.

In contrast, Parasaran argued that a single dissenting opinion from one examining committee member should not outweigh the majority opinion of four members. He urged the court to consider that the production house complied with all 27 cuts and modifications requested by the committee, advocating for the issuance of the certificate without referring the film to another committee.

Parasaran also noted the substantial financial investment made in Jana Nayagan, amounting to ₹500 crore. He expressed urgency about the film’s release, stating that he applied for certification as early as December 18, even utilizing the expedited “Tatkal” procedure to secure timely processing.
