Rafa Mir Rejects Plea Deal That Cut Prison Risk to Under 2 Years

Rafa Mir rejected a prosecution plea deal before his trial on May 28 at the Audiencia Provincial de Valencia, keeping the sexual-assault case on course for a far heavier criminal outcome. The offer would have cut his prison exposure from 10 years and 6 months to less than 2 years and reduced compensation by 24,000 euros.

Before the oral hearing began, the Fiscalía sought a settlement that would have required Mir to admit a double sexual assault and a crime of injury. Instead, he chose to be tried, sitting in the dock of Section Four as the hearing opened in Valencia.

Valencia Courtroom Offer

The numbers at the center of the rejected deal were stark. The proposed sentence would have avoided prison entirely, while the civil payout would have fallen from 74,000 euros to 50,000 euros. That left Mir facing the prosecution’s full request: 9 years in prison for sexual assault and 18 months for injuries.

The case also includes a separate request against Pablo Jara, with prosecutors seeking 4 years for sexual assault and a fine for injuries. The hearing on May 28 turned the focus from a negotiated resolution to what the court will decide after hearing the evidence.

Campaner’s Trial Strategy

Mir’s defense lawyer, Jaime Campaner, based his bid for acquittal on two videos presented at trial. The recordings were taken by Bartolomé, a military friend of Mir who was present during the night out.

Campaner framed the defense in blunt terms during the hearing: “Dato mata a relato”. That line set up the defense’s push to challenge the account that emerged from the woman’s testimony and the prosecution’s case.

The Night Described In Court

According to the testimony heard in Valencia, Mir met a 21-year-old woman in the Mya nightclub, kissed her, and later went to his chalet in the Torre en Conil urbanization. She told the court that he picked her up “como un bebé” and threw her fully clothed into the pool.

She said she told him, “Le pedí que no, que tenía frío,” and later described how he kept her from leaving the water. She told the court: “Me impidió salir del agua, no me soltaba, estaba pegado a mí, le dije que me quería ir pero me cogió la cara, me besó, me tocó todo el cuerpo y me metió los dedos en la vagina”.

After she returned to the house to get her bag, she said Mir grabbed her arm “fuerte” and took her to a bathroom. There, she testified: “Mir me empieza a hacer lo mismo que en la piscina; me altero, me pongo a llorar, me cuesta respirar, le digo que pare, que me deje, tenía miedo, volvió a besarme y a meterme los dedos”.

The plea rejection leaves Mir facing the full criminal case rather than the lighter path the Fiscalía offered. For him, the gap is clear: less than 2 years and no prison on one side, or a trial that can still end with 9 years for sexual assault and 18 months for injuries on the other.
