New York City Mayor Zohran Mamdani and New York Attorney General Letitia James filed a lawsuit Monday to block the Trump administration's plan to expand the public charge rule. The challenge targets a Sept. 18 change that would widen federal authority over visa and green card applications.
Mamdani said at a press conference Monday, "If you are a citizen, or an individual seeking humanitarian relief like asylum, these changes will not affect you," and added that "The new public charge rule not only sweeps aside more than a century of established law, it is intentionally vague as a means of creating uncertainty and fear to isolate immigrant New Yorkers."
Public charge rule change
The public charge rule lets the federal government deny visa applications based on whether an applicant is likely to receive public benefits. The Trump administration seeks to expand the list of benefits covered by that standard, which would give it broader room to reject applications under the revised rule.
That expansion is set to take effect Sept. 18. For immigrants seeking admission or permanent residence, the lawsuit is aimed at stopping the policy before that date arrives, so the current standard remains in place while the case moves forward.

James joined the filing as New York Attorney General, making the challenge a joint legal action against President Donald Trump's administration. The suit asks to block the expansion before it takes effect, which puts the dispute on a direct path to court review.
The immediate question is whether the plaintiffs can stop the Sept. 18 rollout in time. Until a court acts, the administration's plan remains the operative change on the calendar, and applicants facing the rule will have to read the expanded standard against that deadline.
