Kim Zolciak-Biermann put KJ Biermann’s cellphone dispute at the center of divorce proceedings more than a year before his arrest on seven charges. The timeline now runs from a redacted family-court filing to a later criminal case tied to allegations involving a victim under 16.
On Feb. 18, 2025, Kim Zolciak told Fulton County in a motion for an emergency hearing that Kroy Biermann had taken possession of the children’s cellular devices and cut off her access after a discovery that stayed redacted from public records. She wrote, "Mother has had extremely limited parenting time, and Mother has grave concerns for the children’s safety and wellbeing, as well as the preservation of evidence which may be (or may have been) stored REDACTED."
Feb. 18 in Fulton County
Another filing that day sought an in-camera inspection, the kind of closed review a court can use when the contents of a device or filing cannot be handled in open view. In that motion, Zolciak wrote, "In protecting the best interests of the children, Mother will not put into this public pleading what is alleged to be on REDACTED."
On Feb. 7, 2025, Kroy Biermann had already told a court-appointed neutral mental health professional about the same redacted discovery, and the filing said he then directed Zolciak that she would no longer have parenting time with any of the children. The couple share 4 children: KJ, Kane, Kash and Kaia.
Feb. 21 in Cobb County
A filing dated Feb. 21, 2025, in Cobb County referenced an order about inspection of their eldest child’s cellular telephone and the data thereon. The former couple agreed that their attorneys would seek an order governing the handling and inspection of the device, and the court entered an order sealing documents related to the matter the following month.
That sealed record matters because the device at issue belonged to KJ, whose later arrest and indictment turned this private custody fight into a document trail with criminal stakes. Page Six has not independently confirmed any connection between the phone dispute and the later criminal case, or what, if anything, his parents knew about the phone’s contents at the time.
KJ Biermann’s seven charges
Earlier this month, a grand jury in Georgia indicted KJ on 7 total charges: aggravated child molestation, aggravated sodomy, aggravated sexual battery, three counts of aggravated sexual battery against a child under 16 and false imprisonment. He was arrested on Aug. 17 and has been held at Atlanta’s Metro Regional Youth Detention Center since then.
The charges stem from alleged acts on April 23 at Life Time Fitness in Alpharetta, where the victim was under 16. Jason Sheffield denied the claims against his client in a statement obtained by Page Six.
The sealed phone record leaves the hardest question intact: what, exactly, triggered the redacted discovery that moved from divorce proceedings into a criminal timeline? Until that piece is made public, the most relevant fact for readers is the date order itself — the phone was seized first, and the arrest came much later.
