Lawsuit Claims Passenger Consumed 33 Drinks Before Fatal Cruise Incident

A tragic incident aboard a Royal Caribbean cruise has led to a lawsuit claiming that a passenger consumed 33 alcoholic drinks before his death. The family of Michael Virgil alleges that his demise was exacerbated by the actions of the cruise staff.

Incident Overview

On December 13, 2024, Michael Virgil boarded a Royal Caribbean cruise from Los Angeles to Ensenada, Mexico. He was traveling with his fiancée, Connie Aguilar, and their 7-year-old son. Due to their cabin not being ready, they waited in a bar area with live music.

Alcohol Consumption and Behaviors

According to the lawsuit filed in Florida, crew members served Virgil at least 33 alcoholic beverages. He had purchased the “Deluxe Beverage Package,” which allows for all-inclusive drinks. Despite showing signs of intoxication, he continued to receive service.

  • Date of Incident: December 13, 2024
  • Route: Los Angeles to Ensenada, Mexico
  • Number of Drinks Consumed: 33

Confrontation and Death

As Virgil became increasingly frustrated and disoriented, having difficulty locating his family’s cabin, he became aggressive. In response, crew members restrained him using physical force, pepper spray, and a sedative known as Haloperidol.

Medical Findings

The Los Angeles County Medical Examiner determined that Virgil’s death resulted from mechanical asphyxia, compounded by obesity, cardiomegaly, and ethanol intoxication. The office classified the death as a homicide.

Legal Action

Kevin Haynes, representing Virgil’s family, stated that this situation highlighted the negligence of Royal Caribbean in prioritizing profits over passenger safety. The family is seeking damages for loss of support, inheritance, as well as medical and funeral costs.

Response from Royal Caribbean

In a statement, a Royal Caribbean representative expressed condolences but refrained from commenting on the pending litigation, citing ongoing cooperation with authorities during the investigation.

The fallout from this incident represents a significant issue regarding the responsibilities of cruise lines in ensuring passenger safety amidst their beverage service policies.
