On December 13, 2024, Michael Virgil boarded a Royal Caribbean cruise from Los Angeles to Ensenada, Mexico. He was traveling with his fiancée, Connie Aguilar, and their 7-year-old son. Due to their cabin not being ready, they waited in a bar area with live music.

According to the lawsuit filed in Florida, crew members served Virgil at least 33 alcoholic beverages. He had purchased the “Deluxe Beverage Package,” which allows for all-inclusive drinks. Despite showing signs of intoxication, he continued to receive service.
