A court in Livorno has recently mandated a yacht owner to compensate for damages incurred during a docking incident. The Portoferraio court ordered the owner of the sailing yacht Ely J to pay €36,000 following a collision with a motorboat named Mister A.

Details of the Docking Incident

The incident took place in the summer of 2022. It occurred at the “Cosimo de’ Medici” tourist marina in Portoferraio. During docking maneuvers, the Grand Soleil Maxi-One yacht Ely J struck the motorboat Mister A, which was properly docked. The collision caused damage to the starboard side of the motorboat.

Legal Proceedings

The collision did not result in any injuries; however, it initiated a legal dispute between the yacht’s owner and the motorboat’s owner. The motorboat owner, a 79-year-old Milanese resident in Switzerland, claimed full compensation for repairs exceeding €81,000. Ely J’s insurance company offered just over €28,000, an amount deemed inadequate.

The court estimated the damage, excluding VAT, to be over €53,000. After accounting for the amount already compensated by insurance, Judge Simona Capurso ruled that the owner of Ely J must pay €36,000, along with interest accrued since the incident and additional technical and legal costs.

The managing company of Ely J intends to seek further compensation from the insurance company for the unpaid damages. This case underscores the substantial economic implications of maritime collisions in ports and highlights the importance of thorough insurance coverage considerations.
