Brandy Buckley, 43, claims she ingested a metal nail and several sharp metal shards while enjoying a dessert purchased from Bruster’s Ice Cream in September 2018.

While ordering a butter pecan ice cream, Buckley discovered a metal nail embedded in the cone as she attempted to scoop some out for her son. “I thought it was a pecan,” she stated, but soon realized she had swallowed the nail.
After feeling something stuck in her throat, Buckley visited a hospital for an X-ray, which confirmed her fears: she had swallowed not only the nail but also two metal shards. These foreign objects became lodged in her intestines, necessitating surgery. Following the operation, she developed a blood clot, which has resulted in her permanent infertility.

In 2019, Buckley filed a lawsuit against Malabar Creameries, alleging negligence for failing to ensure the safety of their products. The lawsuit revealed that the ice cream contained “multiple metal nails and/or shards.” Buckley cited severe injuries to her head, neck, and limbs, along with lasting neurological effects and the inability to have more children.
