NAACP Sues xAI Over 27 Turbines in Xai Protest
NAACP filed a lawsuit in the xai protest over 27 natural gas-burning turbines xAI and MZX Tech, LLC installed and operated in Southaven, Mississippi without an air permit. The case puts the company’s fast buildout in direct conflict with nearby residents who live, work, and study near the power plant.
Abre' Conner on clean air
Abre' Conner, the NAACP Director of Environmental and Climate Justice, said, "Our right to clean air is not up for negotiation, especially when companies prove expediency not people is their priority." The suit asks a court to force xAI to stop operations until proper permits are in place, add pollution controls, and pay civil penalties.
Southaven turbines and permits
The filing says xAI and its subsidiary installed and operated the 27 turbines between August and December 2025. It also says the turbines were run without regard for the health and safety of people nearby.
The complaint says the units emit smog-forming pollutants and particulate matter. The company tried to sidestep federal permitting requirements by calling the turbines temporary.
Greater Memphis health concerns
Tens of thousands of people live, work, and study near xAI's power plant. Hundreds of thousands more live in greater Memphis. The filing also says a much larger share of the nearby population is Black than the country's population as a whole, placing the dispute in an environmental justice frame rather than a narrow permitting fight.
xAI is planning 41 permanent turbines for a full-scale power plant in the same area. The unresolved question is whether the court will order shutdowns, pollution controls, and penalties before that larger buildout advances.
