Bank Of America Agrees To $2.25M Bank Of America 7-eleven Settlement

Bank of America agreed to a $2.25 million bank of america 7-eleven settlement over claims it charged more than one out-of-network balance inquiry fee during a single visit at 7-Eleven ATMs. The deal covers accountholders who were assessed those fees at an FCTI ATM in a 7-Eleven store between May 1, 2018, and Nov. 16, 2021.

Current Bank of America accountholders do not need to file a claim to receive settlement benefits. Former accountholders must file by June 29, 2026, if they want a payment, while the deadline to exclude themselves or object is July 7, 2026.

Schertzer v. Bank of America

The settlement resolves Schertzer, et al. v. Bank of America N.A., et al., Case No. 3:19-cv-00264-DMS-MSB, in the United States District Court for the Southern District of California. Plaintiffs alleged that Bank of America breached its contract with customers by charging multiple out-of-network fees for balance inquiries at 7-Eleven ATMs, and said some customers were charged two out-of-network fees for a single balance inquiry.

Bank of America has not admitted any wrongdoing. The class member payment will be a proportional share of the net settlement fund based on the number of claims filed, and no payment estimates are available at this time.

June 29 and July 7, 2026

The claim form deadline is June 29, 2026, which makes the filing decision the immediate step for former accountholders who think they fall inside the class period. Kroll Settlement Administration is handling the settlement notice process, with requests and forms tied to that administration.

The exclusion and objection deadline is July 7, 2026, and the final approval hearing is scheduled for Aug. 21, 2026. The settlement also applies only to accountholders who did not make a valid claim and receive payment in Weiss v. FCTI Inc., narrowing the pool to people who were still exposed to the challenged fee pattern at the same FCTI-owned ATMs inside 7-Eleven stores.

Accountholders who used a Bank of America card at a 7-Eleven ATM during the class period face a simple split: current customers are already covered, while former customers must file before the June 29 deadline to be paid.
