David Protein is at the center of a class action lawsuit over allegations of inaccurate calorie and fat content in its protein bars. The legal complaint was filed by three consumers in the U.S. District Court for the Southern District of New York on January 23.
Allegations of Misrepresentation
The lawsuit asserts that David Protein bars contain significantly more calories than advertised. Testing conducted using the Atwater factor revealed that the products could exceed declared calorie counts by up to 83%. Furthermore, the complaint indicates that fat content might be as much as 400% higher than what is stated on the packaging.

Linus Technologies, a food technology firm founded by Peter Rahal in 2023, is named as the defendant in this case. Rahal, who co-founded David Protein and RXBAR, responded to the allegations in an interview with Vanity Fair.

Rahal defended the accuracy of the product’s labeling, asserting compliance with FDA requirements for nutritional content. He explained that the lawsuit fails to recognize how the FDA measures calories for EPG, a key ingredient in their bars. The company pledges to vigorously defend against these claims.
