Bank Of America 7 Eleven Settlement Resolves $2.25 Million ATM Fees

Bank Of America 7 Eleven Settlement Resolves $2.25 Million ATM Fees

Bank of America 7 eleven settlement terms put $2.25 million on the line for accountholders who say they were charged more than one out-of-network balance inquiry fee during the same visit to a 7-Eleven ATM. The deal covers fees tied to FCTI-owned machines inside 7-Eleven stores between May 1, 2018, and Nov. 16, 2021.

For current Bank of America accountholders, the path is simple: no claim form is required to receive settlement benefits. Former accountholders must file a claim by June 29, 2026, or they will not be paid from the fund.

Schertzer Case No. 3:19-cv-00264-DMS-MSB

The settlement resolves Schertzer, et al. v. Bank of America N.A., et al., Case No. 3:19-cv-00264-DMS-MSB, in the United States District Court for the Southern District of California. Plaintiffs said they were charged two out-of-network fees for a single balance inquiry at 7-Eleven ATMs, and the complaint said that breached Bank of America’s contract with customers.

Bank of America has not admitted any wrongdoing. That leaves the payment structure to carry the weight of the deal: class members can receive a proportional share of the net settlement fund based on the number of claims filed, so the eventual payout depends on how many eligible former accountholders take the step to submit paperwork.

June 29 and July 7, 2026

June 29, 2026 is the claim form deadline for former Bank of America accountholders, while July 7, 2026 is the deadline for exclusion and objection. The settlement administrator is Kroll Settlement Administration, and the settlement website lists Schertzer v. Bank of America c/o Kroll Settlement Administration, P.O. Box 225391, New York, NY 10150-5391, with phone number 833-447-8321.

July 7, 2026 also matters for anyone who wants out of the deal or wants to object before the court considers final approval. The final approval hearing is scheduled for Aug. 21, 2026, giving eligible customers a set window to decide whether they want a share, a challenge, or neither.

Aug. 21, 2026 Hearing

Aug. 21, 2026 is the date set for final approval, and it is the point at which the court will decide whether the $2.25 million settlement can move from proposal to payout. For customers who were charged more than one out-of-network balance inquiry fee at a 7-Eleven ATM during the covered period, the practical choice is straightforward: current accountholders can stay in automatically, while former accountholders have to file by June 29 to preserve a claim.
